The Rafah Holocaust Complaint



Officials of the UN have raised voices warning of a catastrophic humanitarian outcome of the slaughter in Rafah for weeks against Israel and America’s planned attacks on the southern portion of Gaza known as Rafah on the border with Egypt.

The Egyption government has been building up troop levels along that border as Israel tries to push over a million Palestinians into the Sinai Desert, or kill them all according to a woman member of RINJ Women who works for a senior cabinet minister in Israel, “who would be out of a job if Prime Minister Netanyahu didn’t keep this genocide raging,” with American, British, Canadian, EU and Japanese complicity.

Egypt has threatened to vacate its peace treaty with Israel.

South Africa has approached the International Court of Justice which one should note is not tiptoeing around this matter but slamming down hard relative to its normal waiting-for-years mode.

South African ministers and their cadre of superlative lawyers, the best in the world in these matters, has implored the World Court to take action and stop the genocide because Israel has launched a massive ground offensive in Rafah where an estimated 1.37 million Palestinians have fled raising the population from 280,000 people to a staggering 1.4 million in the tiny area.

1.By way of an order dated 26 January 2024, the International Court of Justice (ICJ’) indicated six provisional measures against Israel (Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v. Israel), Order of 26 January 2024 or ‘Order’). In making the Order, the Court ruled that there “is urgency, in the sense that there is a real and imminent risk that irreparable prejudice will be caused to the rights found by the Court to be plausible, before it gives its final decision”. Such rights included the “right of the Palestinians in Gaza to be protected from acts of genocide and related prohibited acts identified in Article III” of the Convention on the Prevention and Punishment of the Crime of Genocide (‘Genocide Convention”).

2. There has since been a significant development in the situation in Gaza requiring the Court’s urgent attention. On Friday 9 February 2024, the Office of the Prime Minister of the State of Israel issued the following announcement:

3.”It is impossible to achieve the goal of the war of eliminating Hamas by leaving four Hamas battalions in Rafah. On the contrary, it is clear that intense activity in Rafah requires that civilians evacuate the areas of combat. Therefore, Prime Minister Benjamin Netanyahu has ordered the IDF and the security establishment to submit to the Cabinet a combined plan for evacuating the population and destroying the battalions.”
Despite strong denunciation by the international community, including by some of Israel’s closest allies, the Israeli Prime Minister reiterated in an interview broadcast on Sunday 11 February 2024 that: “[v]ictory is within reach. We’re going to do it. We’re going to get the remaining Hamas terrorist battalions in Rafah, which is the last bastion, but we’re going to do it”. Thereafter, on Sunday evening, Rafah was subjected to an intense, unprecedented Israeli military assault, with an ongoing threat of yet further intensification of the assault- including by way of an Israeli ground invasion.”

4. Rafah, normally home to 280,000 Palestinians, currently houses-primarily in makeshift tents -more than half of Gaza’s population, estimated at approximately 1.4 million people, approximately half of them children. They fled to Rafah, pursuant to Israeli military evacuation orders, from homes and areas that have been largely destroyed by Israel. As the International Committee of the Red Cross has made clear, there is “no option” for the evacuation of the Palestinian population in Rafah as “there is nowhere else for the people to go”.

5.The United Nations Secretary-General has stated unequivocally that a large-scale military assault against Rafah “would exponentially increase what is already a humanitarian nightmare with untold regional consequences”? The United Nations Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967 has starkly warned that “[t]he risk of a massacre of unparalleled scale looms on the horizon”. 10 UNICEF has urgently highlighted the “need” for “Gaza’s last remaining hospitals, shelters, markets and water systems” – which are in Rafah – “to stay functional”, underscoring that “without them, hunger and disease will skyrocket, taking more child lives”. ” The Commissioner-General of UNRWA, referring to the “growing panic in Rafah”, has made clear that “any large-scale military operation among this population can only lead to an additional layer of endless tragedy that’s unfolding”, “reiterating that “a military offensive in the middle of these… Source


Palestinians have fled all other parts of the Gaza strip to escape bombing and thus the renewed brutal attacks with American bombs plus tank and field artillery rounds represent an unspeakable crime against humanity in what has become the most population dense area of the entire world, mostly women and children. For years, their men are long gone although many thousands are imprisoned by Israel, others just killed in the tens of thousands over the years.

Palestinian Journalists Ismail Abu Omar and Ahmed Matar, dead in the Rafah Holocaust, were struck after American and Israeli drones track them for an hour. Over 160 journalists have been murdered in Gaza. America and Israel are taking great strides to block the flow of truth from Gaza.


What may turn out to be the understatement of the 21st century, South African documents sent to the World Court say this is “further imminent breach of the rights of Palestinians in Gaza”. 

But it has happened already. Since Friday, NWOB.org experts say, “over 1,000 Palestinians have been killed in the Rafah Holocaust, in just hours,” explains NP Sandra Ellingsworth who adds that there are bodies everywhere and nobody to provide proper services for their removal.
